These Terms and Conditions apply to the use of the TOUR NOIR website and the purchase of digital publications from the TOUR NOIR online shop.
By placing an order, you confirm that you have read and accepted these Terms and Conditions.

TOUR NOIR creates and sells independent digital travel guides and editorial publications. Products currently offered through the online shop are downloadable PDF files.
No physical product will be shipped unless a product page expressly states otherwise.
The contents, format, page count, price, and principal features of each publication are described on its individual product page.

Prices are displayed in Swiss francs unless otherwise indicated. Any applicable taxes or additional charges will be shown during checkout before payment is completed.
Payments are processed securely through Stripe. TOUR NOIR does not directly store customers’ complete card details.
An order is considered confirmed after successful payment and the issuing of an order confirmation.
If an order cannot be fulfilled because of a technical or pricing error, TOUR NOIR may cancel the order and refund the amount paid.

After successful payment, the purchased files will normally be made available on the order-confirmation page and through a download link sent to the email address provided during checkout.
Customers are responsible for providing a valid email address and for checking spam or promotions folders if an order email does not arrive.
If a download link is missing, expired, or not functioning, contact info@tournoir.ch with your name and order number.

Purchasing a TOUR NOIR publication grants the customer a limited, non-exclusive, non-transferable license to use the file for personal, non-commercial purposes.
Customers may download the publication to their personal devices and print copies for their own personal use.
Customers may not:
• Share or distribute the digital file
• Upload it to another website, platform, shared drive, or file-sharing service
• Resell, sublicense, reproduce, or commercially exploit the publication
• Remove copyright notices
• Present TOUR NOIR content as their own
• Use the publication, its text, design, maps, or other content to create another commercial product
All rights not expressly granted remain with TOUR NOIR and the respective credited rights holders.
Because TOUR NOIR publications are digital products supplied immediately after payment, purchases are generally final once a file has been accessed or downloaded, except where otherwise required by applicable law.
Customers who accidentally purchase the wrong publication or experience a technical problem should contact TOUR NOIR before downloading the file.
If a file is defective, incomplete, or inaccessible, TOUR NOIR will first attempt to provide a functioning replacement or renewed download access. Where the problem cannot reasonably be resolved, an appropriate refund may be issued.
Nothing in these Terms limits any mandatory consumer rights that apply to the customer.
TOUR NOIR publications are independent editorial guides intended for general information and inspiration.
Transport schedules, prices, opening hours, access conditions, accommodation details, road conditions, regulations, and other travel information may change after publication. Customers should verify essential information directly with the relevant operator, destination, or official authority before traveling.
Travel decisions remain the responsibility of the traveler. Customers should consider current weather, health, mobility, road, and safety conditions when planning an activity or journey.
TOUR NOIR publications and website pages may contain references or links to independent websites, accommodations, restaurants, transport providers, tourism organizations, or other third parties.
Unless expressly stated otherwise, these references do not represent a commercial partnership or guarantee. TOUR NOIR does not control third-party services, availability, policies, pricing, or website content.
Unless otherwise credited, the TOUR NOIR name, branding, written content, original graphics, publication layouts, and editorial designs are owned by TOUR NOIR and are protected by applicable intellectual-property laws.
Photographs and other third-party materials remain the property of their respective creators or rights holders and are used under permission, license, or applicable usage terms.
TOUR NOIR will provide purchased digital files with reasonable care and will assist with legitimate delivery or access problems.
To the extent permitted by law, TOUR NOIR is not responsible for losses arising from reliance on outdated third-party information, changes to travel services or conditions, personal travel decisions, or the actions of independent third-party providers.
Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.
Personal information submitted through the website is processed in accordance with the TOUR NOIR Privacy Policy.
Payment information is processed by Stripe under Stripe’s own terms and privacy practices.
TOUR NOIR may update these Terms and Conditions to reflect changes to its products, services, or legal obligations. The version published at the time of an order will apply to that purchase.
These Terms are governed by Swiss law.
Any mandatory consumer protections that apply in the customer’s place of residence remain unaffected. Where legally permissible, disputes will be subject to the competent courts of Basel, Switzerland.
